These Terms of Service ("Terms") form a binding agreement between you and Goshen Consulting LLC ("we," "us," or "our") governing your use of Volyia, including our website and mobile applications (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Volyia is a routine and wellness application. The free version currently includes alarm and active wake modes, day types and three-step routines, daily check-ins with Momentum points, and starter achievement badges. Volyia Plus currently adds personalized AI-assisted insights, weekly improvement badges, a monthly progress report, and optional Apple Health sleep information on supported iPhones. Features can differ by device, operating system, region, and release.
Volyia is not a medical device and does not provide medical, psychological, or healthcare advice. The Service — including its Rhythm Score, pattern insights, sleep and mood tracking, and wellness suggestions — is for informational and self-improvement purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any questions about your health, sleep, nutrition, mental wellbeing, or exercise. Never disregard professional medical advice because of something you read or saw in Volyia. If you think you may have a medical emergency, contact emergency services immediately.
You must be at least 18 years old to use Volyia. By using the Service, you represent and warrant that you meet this requirement and that the information you provide is accurate.
A Volyia account is optional for the free local routine experience and required for cloud AI coaching. You are responsible for safeguarding account credentials and activity under your account. Notify us promptly at support@goshenconsultingllc.com if you suspect unauthorized use. You may delete a connected account or erase guest data from within the app.
Volyia offers a free tier and optional paid subscriptions called Volyia Plus. The purchase screen presented by Apple or Google shows the authoritative local price, billing period, trial eligibility, renewal date, and taxes, if any, before you confirm a purchase.
We may change prices, plan names, or included features prospectively. A change does not alter a completed billing period. Existing subscription price changes are handled through Apple or Google and are subject to their notice, consent, and renewal rules. If a store or applicable law requires your consent and you do not provide it, the subscription may expire or not renew at the changed price. You can cancel before a future renewal or price change takes effect. Nothing in these Terms limits non-waivable consumer rights.

Volyia Plus can surface AI-assisted observations based on information you choose to log. Cloud AI features require a connected account and an explicit data-sharing choice. Volyia sends a compact summary that omits your name and email to Anthropic to generate the requested result. Apple Health sleep information requires an additional, separate choice. These observations are general wellness information, not directives, and can be incomplete or inaccurate.
Volyia can request permissions needed for alarms, notifications, motion-based wake modes, and other device features. On supported iPhones, eligible Plus users can optionally permit read-only access to Apple Health Sleep Analysis. Volyia does not write to Apple Health. Connecting Apple Health is separate from allowing its summaries to be included in cloud AI requests; either choice can be refused or revoked without disabling the other. See our Privacy Policy.
The Service and all of its content, features, design, software, and underlying technology are owned by Goshen Consulting LLC and protected by intellectual property laws. The Volyia name, logo, and branding are trademarks of Goshen Consulting LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. The data you create (your logs, plans, and entries) remains yours.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that alarms, notifications, or insights will always be delivered accurately or on time. You are responsible for any consequences of relying on the Service, including for waking up on time.
To the fullest extent permitted by law, Goshen Consulting LLC and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
We may suspend or terminate your access to the Service at our discretion if you violate these Terms or use the Service in a way that could harm us or other users. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
We may add, modify, or discontinue Service features, including which features are free or included in a paid plan. We may also update these Terms. For material changes, we will provide reasonable advance notice through the Service, email, or another appropriate method where required, and we will update the date above. Changes apply prospectively. Continued use after the effective date means acceptance only where permitted by law; when applicable law requires affirmative consent, we will request it. If you do not agree, you may stop using the Service and cancel any renewing subscription before the change takes effect.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in New Jersey, unless otherwise required by applicable law.
